Debt collectors often engage in unethical and even illegal conduct. They even abuse victims of identity theft, victims who do not legally owe these debts. If this happens to you, don’t forget that you have legal protections and remedies at your disposal.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act (FDCPA) bars third-party debt collectors from bullying or coercing consumers into paying their debts. This means that strategies like the following can result in penalties and even loss of the agency’s license.

  • Trying to charge you a fee to make a debt payment
  • Failing to identify themselves as debt collectors trying to collect a debt
  • Calling your family and telling them that you owe money
  • Using profane and abusive language
  • Calling you several times a day
  • Demanding outrageous ‘fees’ in addition to the original debt
