According to PACER, on or about November 14, 2013, Michigan resident Edith Brooks received a letter from Jaffe & Asher, LLP in an attempt to collect on her overdue American Express account. In the letter, the firm allegedly threatened to file a lawsuit against Ms. Brooks to recover the debt and send the account to “local counsel” to resolve, although no lawsuit ever transpired.
Feeling harassed by Jaffe & Asher, LLP, Ms. Brooks hired a consumer attorney and sued the firm for allegedly violating the FDCPA by threatening legal action it did not intend to take.
The matter was later dismissed.
