Alleged Violations By BC Services, Inc.
According to PACER**, on or about August 12, 2013 BC Services, Inc. sent a Colorado resident a collection letter about a debt allegedly owed to Centura-Littleton.
In this letter, which was later produced as an exhibit, the agency stated:
“[u]nless, within 30 days after the receipt of this notice you dispute the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the creditor and by the Firm. If you notify us in writing within said 30 days that the debt or any portion thereof is disputed, we will obtain verification of the debt, or obtain a copy of a judgment against you, and we will mail such verification to you.
In addition, upon your written request within said 30 days, this Firm will provide the name and address of the original creditor if the original creditor is different from the current creditor.”
On or about September 9, 2013, BC Services, Inc. sent another collection letter. The Colorado resident replied by disputing the debt in writing and asking for documentation to validate the debt.
No documentation allegedly arrived, but BC Services, Inc. sent her another collection letter dated December 12, 2013.
On or about January 15, 2014 the Colorado resident notified BC Services, Inc., through her counsel, that she was represented by an attorney and provided the attorney’s contact details.
BC Services, Inc. acknowledged the representation by sending correspondence to her counsel dated February 7, 2014, but allegedly sent another collection letter to the Colorado resident directly.
Feeling harassed by BC Services, Inc., she hired a consumer attorney and sued the company for allegedly violating the FDCPA in the following ways:
- Contacting her directly when she was represented by an attorney
- Failing to send a debt validation letter after the first communication
The matter was later dismissed.
