Brenda Radford vs. Leikin, Ingber & Winters, P.C.*

According to PACER, on or about July 14, 2011, Leikin, Ingber & Winters, P.C. filed a lawsuit against Michigan resident Brenda Radford on behalf of its client, a hospital. The firm allegedly represented to the district court that Ms. Radford lived in Bloomfield Hills, Michigan, but she did not reside there when the lawsuit was filed.

After the suit was filed but prior to service on Ms. Radford, Leikin, Ingber & Winters, P.C. allegedly received notice that she resided in Goodrich, Michigan but failed to advise the court that she was no longer in Bloomfield Hills. Ms. Radford later alleged that instead of refiling the lawsuit in the appropriate venue, the firm changed the address on the summons and caused her to be served with a lawsuit in the incorrect venue.

Feeling harassed by Leikin, Ingber & Winters, P.C., Ms. Radford hired a consumer attorney and sued the firm for allegedly violating the FDCPA by proceeding with a lawsuit in a county where she did not reside.

The matter was later settled.
