Are you being called by J.A. Cambece Law Office, P.C.?* Here’s what you need to know.
When a debt collector makes contact with you, they will push for immediate payment and often be unpleasant when you refuse. They’d rather you didn’t know that there are rules collection agencies must follow when they contact you to pay a debt.
Your Rights Under the FDCPA
Prior to 1977, aggressive debt collectors were causing bankruptcy levels to shoot up. Congress passed the Fair Debt Collection Practices Act, or FDCPA, which prohibits deception and abuse during the debt collection process. Tactics like those below can actually get an agency shut down.
- Calling you at inconvenient times and places, such as before 8:00 a.m. and after 9:00 p.m. in your time zone
- Failing to identify themselves as debt collectors trying to collect a debt
- Demanding amounts not supported by law or the original creditor agreement
- Using profane or obscene language
- Talking to your friends and family about your debt
- Contacting you directly even after you’ve hired an attorney to represent you in the matter
