Alleged Violations against Hamerhoff Law Group*
Hamerhoff Law Group is a debt collection law office located in Tucson, Arizona. It was established in 1983, has approximately five employees, and is managed by its President, Mr. David Hameroff Esq. Records archived at the PACER (Public Access to Court Electronic Records) website confirm that Hamerhoff Law Group has been accused of violating the FDCPA during certain consumer interactions.
In or around 2014, Hamerhoff Law Group contacted an Arizona consumer in an attempt to collect a debt that was incurred by her estranged husband.
The husband incurred the debt prior to his marriage to the consumer, and at the time had been married to another woman.
On multiple occasions, Hamerhoff Law Group allegedly called the consumer and asked to speak with her husband and his previous wife. She advised each caller that she was not the husband or the previous wife, provided them with contact information for both, and asked them to stop calling, but the calls allegedly continued, some of them during work hours.
Hamerhoff Law Group eventually initiated legal action against the consumer, but she denied having been served with legal process.
A default judgement was therefore received, followed by wage garnishment, so she hired a consumer attorney and sued the law office for the following alleged FDCPA violations:
- Causing her telephone to ring constantly and engaging her in annoying conversations
- Using false, deceptive and misleading means to collect a debt
- Misrepresenting the legal status of the debt
- Threatening action that could not legally be taken
- Using unfair and unconscionable means to collect a debt
- Attempting to collect an amount not permitted by law or the original creditor agreement
The matter was later settled.
