Debt collectors are not the easiest or most pleasant people to deal with. Their mission is to get you to pay a debt quickly, and in full, so they can get paid too. Consequently, they can be intrusive, zealous, and even aggressive. Your Rights Under the FDCPA

The Fair Debt Collection Practices Act, or FDCPA, requires third-party collection agencies to be both ethical and professional when attempting to collect a debt. Practices like those below are illegal and can subject the collector to serious consequences:

  • Using abusive and / or obscene language
  • Calling you several times a day
  • Demanding amounts that exceed the original debt and are not supported by law or the original creditor agreement
  • Telling you that you will arrested and sent to jail if the debt is not paid
  • Contacting you directly after you retain an attorney
  • Keep contacting you even after you dispute a debt or demand its validation

Company Profile: Synergetic Communication Inc.

Synergetic Communication Inc. is a collection agency with offices in Houston, Texas, Hopkins, Minnesota, and Post Falls, Idaho. It was established in 1996, has approximately 100 employees spread over the different locations, and is managed by owner Mike Orlando. Records retained by the PACER (Public Access to Court Electronic Records) website, confirm that Synergetic Communication Inc. has been accused of violating the FDCPA when dealing with certain consumers.

Alleged Violations against Synergetic Communication Inc.

Between April and July of 2012, a Massachusetts consumer received several calls from Synergetic Communication Inc. about an alleged debt to Capital One. She later claimed that the collectors called her at home on a near-daily basis and left voice messages revealing that she owed a debt and was being pursued by a collection agency.

The consumer was embarrassed to have this information left on her home telephone, as her voicemail messages could easily have been heard by third parties who had no idea about her financial struggles. She finally hired a consumer attorney and sued Synergetic Communication Inc. for the following alleged FDCPA violations:

  • Engaging in harassing, oppressive, or abusive conduct by leaving multiple voicemail messages on her home telephone
  • Causing her home phone to ring repeatedly and continuously with the intent to annoy or harass her
  • Using unfair or unconscionable means to collect a debt

The matter was later settled.
