Are You Being Called By Atlas Financial Services?

Debt collectors are generally allowed to contact you, but there are rules that they have to follow. Although they are not allowed to violate your privacy or bully you, many of them do. If this happens to you, get a free case review from a consumer lawyer who can help you proceed.

Your Rights Under the FDCPA

While debt collectors are allowed to contact you and make arrangements for you to pay a debt, the Fair Debt Collection Practices Act (FDCPA) prohibits them from using actions like the following:

● Using foul language
● Trying to collect amounts that exceed the original debt
● Pretending to be police officers
● Calling at inconvenient times
● Threatening legal action they cannot take
● Contacting you when you are represented by an attorney

Alleged Violations against Atlas Financial Services

According to PACER, on or around November 15, 2010, Atlas Financial Services started contacting an Oregon consumer about a medical debt. She said that a collector named ‘Ann’ threatened to garnish her wages and take her home away.

Frightened, the consumer agreed to a payment plan, but Ann allegedly called her again in February 2011 and requested that the payments be increased. Ann also allegedly left a detailed voicemail that was heard by the consumer’s fiance.

Feeling harassed by Atlas Financial Services, she filed a lawsuit against the agency for:

● Making threats about foreclosure and wage garnishment
● Being abusive
● Disclosing details of the debt to a third party
● Contacting her after she requested no more calls

The matter was later settled.
