Are You Being Called By Coastal Mitigation Associates?

People everywhere are being chased by collection agencies for debts they don’t owe or can’t afford. It’s a difficult situation that feels even worse when the debt collector is determined to bully you into paying. If this happens to be the case with you, learn more about how you can protect your rights.

Your Rights Under the FDCPA

In 1977, the Fair Debt Collection Practices Act, or FDCPA, was passed to regulate the actions of third-party debt collectors. Today, any collection agency that uses strategies like those below with indebted consumers can be fined or lose their license.

● Using profane or obscene language
● Calling at unreasonable and inconvenient times
● Threatening legal actions that they have no intention of taking
● Failing to identify themselves as debt collectors in every communication
● Harassing you by phone
● Trying to collect amounts that are not authorized by law

Alleged Violations against Coastal Mitigation Associates*

According to information on the PACER website, in or around April 2007, Coastal Mitigation Associates allegedly tried to collect a credit card debt from a deceased Pennsylvania consumer by contacting his widow. She insisted that she did not owe it, but collectors allegedly continued to harass her by phone.

During one conversation on or around May 14, 2008, one collector allegedly told her that if she did not pay her late husband’s debt, she would be sued.

Feeling harassed by Coastal Mitigation Associates, the consumer sued the agency for:

● Using harassing and abusive means to collect a debt
● Using false, deceptive, and misleading means to collect a debt
● Using unfair and unconscionable means to collect a debt

The matter was later settled.
