Your Rights Under the FDCPA

The Fair Debt Collection Practices Act (FDCPA) prohibits third-party debt collectors from threatening or bullying people into paying a debt. If they subject you to any of the following collection tactics, they’re breaking the law.

● Failing to identify themselves as a debt collector
● Calling you at work after being told to stop
● Threatening legal actions that they have no intention of taking
● Calling before 8:00 a.m. and after 9:00 p.m. in your time zone
● Using an autodialer to leave a series of pre-recorded messages
● Reporting false information to the credit bureaus

Alleged Violations against DTG Holdings, Inc.

According to PACER, on or around September 22, 2008, DTG Holdings, Inc. sent a collection letter to a Connecticut consumer regarding an auto insurance debt. When it called her, she disputed the debt, said that she had cancelled that policy a long time ago, and faxed proof of cancellation. The collector acknowledged receipt of the fax, but allegedly kept calling and sending letters.

Feeling harassed by DTG Holdings, Inc., the consumer filed a claim against the agency for:

● Ignoring her dispute
● Failing to send a debt validation package
● Misrepresenting the amount and legal status of the debt

The matter was later settled.
