Debt collectors are hardly known for their pleasant interactions. Some have behaved so badly that they’ve been closed down! If you find yourself dealing with this type of debt collector, knowing your rights will guide your next steps.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act (FDCPA) was passed in 1977 to protect consumers from being harassed into bankruptcy. It regulates debt collector conduct and does not allow strategies like those below to be used to collect a debt.

  • Cursing and calling you names
  • Contacting you if they know that you are being represented by an attorney
  • Using an autodialer to contact you nonstop
  • Calling at inconvenient hours
  • Reporting false information to the credit bureaus
  • Demanding amounts not supported by the original creditor agreement
