Alleged Violations against Neuheisel Law Firm*
According to information on the PACER website, on or around December 2, 2011, Neuheisel Law Firm and its client obtained a default judgment against an Arizona consumer. The court awarded the client attorney’s fees in the amount of $800.00 and court costs in the amount of $224.84. According to the court’s order the attorney’s fees and costs would also increase and would “bear interest at the rate of 4.25 percent per annum from the date of this Judgment until this Judgment plus any post petition court costs is paid in full.”
- In connection with the collection of the debt, Neuheisel Law Firm sent the consumer a letter dated February 25, 2016. It stated that the current balance of the debt was $9,087.12 when, according to the consumer, this was $19.75 more than the amount actually owed.
When the consumer’s attorney contacted the firm about the discrepancy, Neuheisel responded that the debt also reflected $38 in post-petition costs, so the correct amount should have been $9,105.37.
The consumer’s attorney requested more information about the discrepancy, and Neuheisel justified it by stating that on or about August 15, 2014, the creditor had stopped charging interest on the court costs of the debt. The consumer alleged that if this was true, the firm had failed to disclose that its client had ceased collecting the court mandated post-judgment interest. Alternatively, if the creditor did not actually waive post-judgment interest on costs, Neuheisel allegedly misrepresented the amount of the debt.
Feeling harassed by Neuheisel Law Firm, the consumer sued the firm for:
- Misrepresenting the character, amount, or legal status of the debt
- Using false, deceptive, and misleading means to collect a debt
- Using unfair and unconscionable means to collect a debt
The matter was later settled.
