This direction frequently manifests itself as aggressive and intrusive measures such as calling the debtor at all hours of the day or night, harassing them at work, or blowing up their phone with an autodialer. Your Rights Under the FDCPA

The Fair Debt Collection Practices Act (FDCPA) was passed in 1977 to protect indebted consumers from having their lives ruined by third-party collection agencies. It penalizes debt collectors who harass you in the following ways:

  • Refusing to provide you with information about the debt upon request
  • Failing or refusing to report a debt as disputed to the credit bureaus
  • Persisting in trying to collect a disputed debt
  • Using profane and obscene language on the phone or in voicemails
  • Threatening to publish your name on a debtor’s list
  • Contacting you directly when they know that you have an attorney

According to information on the PACER website, in or around January 2012, Cash-Pro, Inc. tried to collect a debt from an Indiana consumer by reporting it to the credit bureaus. Her attorney faxed a dispute letter to the agency, but it allegedly did not report the debt as disputed.

Feeling harassed by Cash-Pro, Inc., the consumer took legal action against the agency for:

  • Using harassing and abusive means to collect a debt
  • Using unfair and unconscionable means to collect a debt
  • Using false, deceptive, and misleading means to collect a debt

The matter was later dismissed.
