Are You Being Called By Advantage Financial Services?*

Indebted consumers are often subjected to abuse by third-party debt collectors. Yelling, calling you at work, and threatening lawsuits are all examples of bullying tactics used to stress you into paying the debt, hoping you will never realize that the law protects you from such mistreatment.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act, or FDCPA, limits what third-party debt collectors can say or do when contacting you. If they use methods like those below, they’re breaking the law and can face substantial fines.

  • Threatening legal actions they cannot take
  • Telling you that you can be arrested and imprisoned if you do not pay
  • Disguising the fact that they are debt collectors trying to collect a debt
  • Making legal threats they have no intention of following up on
  • Calling at all hours of the day and night
  • Calling you at work after you’ve told them that your employer doesn’t allow such calls

Alleged Violations against Advantage Financial Services

According to PACER, on or around August 1, 2017, Advantage Financial Services called an Idaho consumer to collect a debt. This communication was followed by a letter stating that she owed $4,200, with a principal balance of $2,655.49.

She was allegedly not advised that the debts were past the statute of limitations except for two accounts that totaled $73.19. The consumer also complained that she received calls from collectors who threatened to sue her if she did not make an immediate payment.

Feeling harassed by Advantage Financial Services, the consumer obtained legal counsel and sued the company for allegedly:

  • Threatening action it could not legally take
  • Using false, deceptive, and misleading means to collect a debt
  • Trying to collect a time-barred debt

The matter was later dismissed.
