According to PACER, on or around May 19, 2016, The Cadle Company sent a collection letter to a New York consumer, demanding payment for a private student loan. She had not paid on this debt, making it legally uncollectible under the laws of New York state, where she now lived.

Feeling harassed by The Cadle Company, the consumer took action against the company by filing a lawsuit for the following alleged actions:

  • Misrepresenting the legal status of the debt
  • Threatening legal action it could not take
  • Using false, deceptive, and misleading means to collect a debt
  • Using unfair and unconscionable means to collect a debt

The matter was later settled.
