According to PACER, in or around October 2013, Red River Collection Company, Inc. started contacting a Colorado consumer to collect a debt. On or around November 11, 2013, she spoke with a female representative named “Jody Lucero” and requested that all calls to her workplace cease, but a dozen more calls allegedly followed.

When the consumer insisted that she could not afford to pay, “Jody” allegedly replied that since she has a job and is making money, Red River Collection Company, Inc. would simply take the money out of her paychecks.

Feeling harassed by Red River Collection Company, Inc., the consumer hired an attorney and sued the agency for allegedly violating the FDCPA in the following ways:

  • Using harassing and abusive means to collect a debt
  • Harassing her by phone
  • Calling at work although such calls were prohibited by the employer
  • Using false, deceptive, and misleading means to collect a debt
  • Using unfair and unconscionable means to collect a debt

The matter was later settled.
