Debt collectors are regulated by state and federal laws, but many of them prefer to ignore the fact because harassment and abuse appear to yield the money they’re looking for.

If you’re being pursued by a collection agency that ignores the law in favor of profit, learn more about your rights and how you can act on them.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act, or FDCPA, requires third-party debt collectors to treat you with respect when communicating with you about a debt. If a company tries to make you pay by using these types of pressure tactics, see a consumer lawyer about protecting your rights.

  • Using profane and obscene language
  • Intentionally reporting incorrect information to the credit bureaus
  • Posing as law enforcement officers to frighten you into paying
  • Calling anyone except you, your spouse, or attorney about the debt
  • Failing to send a debt validation letter within five days of first contacting you
  • Harassing you over a debt that you never incurred

Alleged Violations against We Find Everyone, Inc.

According to PACER, on or around August 3, 2007, a Minnesota consumer received a collection letter from a law firm working with We Find Everyone, Inc. to collect a credit card debt. Five days later, a debt collector called his elderly mother and asked for his work number.

The collector allegedly told her that he was a “U.S. Court official” and that he had a “warrant” for her son’s arrest.

The mother was extremely frightened and provided her son’s work telephone number. A collector then called the consumer at his place of employment and claimed to be “Roger Warsaw” an “official” from the “United States Court.”

He also allegedly said that he had a “bench warrant” for the consumer’s arrest because he had missed his “jury selection,” but that they could grant him an exemption if he was working.

The collector also allegedly said that the jury selection notice had been delivered to the consumer’s home and was “signed for.”

When the consumer asked if the caller was a debt collector, the caller allegedly denied it and hung up, but called him again on August 17. At this time they verified his social security number, at which time the consumer terminated the call and sent a cease and desist letter via certified mail.

Then on August 24, 2007, he received a garnishment summons dated August 21.

Feeling harassed by We Find Everyone, Inc., the consumer took legal action against the agency for allegedly:

  • Using harassing and abusive means to collect a debt
  • Failing to identify itself a debt collector in all communicationst
  • Using unfair and unconscionable means to collect a debtt
  • Using false, deceptive, and misleading means to collect a debtt

The matter was later settled.
