Serious debt can happen to anyone. Losing your job, becoming sick or disabled, and facing an unexpected crisis like divorce can all put you behind in your debt payments and bring you to the attention of a collection agency.
If you are being harassed, however, don’t tolerate it no matter how much you owe.
Your Rights Under the FDCPA
The Fair Debt Collection Practices Act, or FDCPA, is a consumer protection law that prohibits debt collectors from engaging in unethical and abusive debt collection activity. Examples of illegal collection practices include:
- Failing to identify themselves during each communication as a debt collector
- Contacting you after you have sent a cease communications letter
- Sending you letters using letterhead designed to look like a law enforcement agency
- Using profane or obscene language
- Calling you at inconvenient times and places

Alleged Violations against Icon Equities, LLC
According to PACER, in or around early 2011, a representative of Icon Equities, LLC started contacting an Illinois consumer about a credit card debt.
On October 13, 2011, one of her Legal Aid attorneys faxed the agency and directed it to cease all further collection activities because she was forced, by her financial circumstances, to refuse to pay her unsecured debt.
Despite receipt of this fax, the consumer received another demand letter dated November 14, 2011. Feeling harassed by Icon Equities, LLC, she filed an FDCPA lawsuit against the company for the followed illegal debt collection practices:
- Ignoring a cease communications fax
- Contacting her directly although she had an attorney
The matter was later dismissed.
