Alleged Violations against ATG Credit, LLC
According to PACER, in or around July 2016, ATG Credit, LLC started trying to collect a student loan debt from a Florida consumer by reporting it to multiple credit bureaus.
Around November 24, 2017, the consumer disputed the debt with Equifax, which sent ATG Credit, LLC an Automated Consumer Dispute Verification (ACDV) request asked that the company make a reasonable investigation into the dispute.
On or around December 15, 2017, it responded to the ACDV and stated that its information was accurate and should remain unchanged.
Around January 16, 2018, the consumer disputed the debt again to Equifax, so Equifax sent ATG Credit, LLC another ACDV. On or around February 3, 2018, the company repeated that its information was accurate and should remain unchanged, but allegedly failed to update its reporting to reflect a “disputed” status.
Feeling harassed by ATG Credit, LLC, the consumer obtained legal counsel and sued the company for allegedly:
- Failing to report the debt as disputed
- Using unfair and unconscionable means to collect a debt
- Using false and deceptive means to collect a debt
The matter was later settled.
