Are You Being Called By Heritage Financial Recovery Services?*

As a consumer, you have the right to be treated fairly and ethically by debt collectors. This right is also part of a federal law. Unfortunately, not all debt collectors follow the rules.

They call you late at night or at the crack of dawn, threaten to seize your assets, and ignore any dispute letters. They try to make you believe that they have all the power, when in truth the law is on your side.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act, or FDCPA, prohibits third-party debt collectors from engaging in deceptive and abusive behavior. If you are dealing with a collection agency that uses tactics like those listed below, you can sue them.

  • Using profane or obscene language
  • Contacting you directly even after you’ve hired an attorney to represent you in the matter
  • Persisting in trying to collect a disputed debt
  • Reporting false information to the credit bureaus
  • Harassing you by telephone (e.g. calling and hanging up)
  • Calling at inconvenient times, usually before 8:00 a.m. and after 9:00 p.m

Alleged Violations against Heritage Financial Recovery Services

According to PACER, on or about October 10, 2104, Heritage Financial Recovery Services sent a collection letter to a New Jersey consumer, seeking payment for a medical debt.

She later complained that her account number was visible above her name on the front of the envelope, and that the account number could identify her as a debtor, in violation of the FDCPA.

Feeling harassed by Heritage Financial Recovery Services, the consumer sued the company for allegedly violating her rights in the following ways:

  • Using unfair and unconscionable means to collect a debt
  • Making her personal information available to outside parties
