Your Rights Under the FDCPA

The Fair Debt Collection Practices Act, or FDCPA, prohibits debt collectors from engaging in harassing and oppressive debt collection practices. When a consumer has been subjected to abusive tactics like those below, he or she can sue the debt collector in court.

  • Calling before 8:00 a.m. and after 9:00 p.m. in the consumer’s time zone
  • Talking to anyone except the consumer, their spouse, or their attorney about the debt
  • Failing or refusing to identify themselves as debt collectors in every communication
  • Using profane or obscene language
  • Calling you at work when your employer does not allow such calls
  • Failing to report to the credit bureaus that a debt is in dispute

Samantha Case vs. Torres Credit Services, Inc.

According to PACER, on or about July 9, 2012, Torres Credit Services, Inc. sent a collection letter to a Pennsylvania woman. She later complained that the window envelope left part of her account number with the company visible.

Feeling harassed by Torres Credit Services, Inc., she hired a consumer attorney and sued the agency for allegedly violating the FDCPA in the following ways:

  • Using unfair and unconscionable means to collect a debt
  • Sending a collection letter in a manner that left her private information visible

The matter was later dismissed.
