If a debt collector is harassing you, they’re actually breaking federal law. The Fair Debt Collection Practices Act, or FDCPA, prohibits abusive tactics like the following when used to collect a debt.

  • Using profane or obscene language
  • Telling you that you can be arrested for not paying your debts
  • Calling you at work if they know or have reason to know what such calls are not allowed
  • Telling your friends and family that you owe money
  • Threatening action they cannot legally take or have no intention of taking
  • Leaving voice messages that do not identify the collector and the purpose of their call

According to PACER, in September 2009 S&S Recovery started trying to collect a debt from a Louisiana resident by calling her repeatedly at work. She kept asking them to stop because such calls were not permitted at her workplace, but the calls allegedly continued.

On one occasion, a collector allegedly threatened her with a lawsuit.

Feeling harassed by S&S Recovery, she hired a consumer attorney and sued the company for allegedly violating the FDCPA in the following ways:

  • Calling her at work despite being told to stop
  • Threatening legal action when none was ever intended
  • Using oppressive and harassing means to collect a debt

The matter was later settled.
