According to PACER,in the month of July, 2013, Oklahoma resident Dustin Haffner agreed to make $50.00 payments to Jana Ferrell & Associates, LLC every two weeks until a medical debt was fully repaid. On that same date of the payment agreement, he specifically asked for agency to not to ever call his place of employment, as his employer did not allow such calls, and told them that if they had any problems, to call his cell phone.
Despite making payments as agreed, on July 16, 2014, a collector named “Danny Guest” called Mr. Haffner’s place of employment and left a voicemail message to call him back. In the voicemail, Mr. Guest allegedly failed to identify the name of his company name or meaningfully disclose the purpose of the call.
Mr. Haffner returned the call and asked Mr. Guest why he was called at work, as he had requested that no such calls be made. The collector allegedly replied that he could call “any number on your record” to get a hold of him.
