According to PACER, in late March 2011 Association Financial Services, LLC sent Florida resident Alina Bergan a collection letter that allegedly failed to provide the necessary debt disclosures and demanded an amount of $1,783.58 that, in subsequent demand letters, inflated into first $2,436.96, and then $2,819.84.

Feeling harassed by Association Financial Services, LLC, she hired a consumer attorney and sued the company for allegedly violating the FDCPA in the following ways:

  • Failing to deliver the required debt disclosures
  • Using false, deceptive and misleading means to collect a debt
  • Misrepresenting the character, amount, or legal status of the debt.

The matter was later settled.
