Debt is one of those things most of us try to avoid, but there are times when the cash is typically not available to pay the monthly loan bill. Maybe there was an unexpected medical bill to pay or someone in the family lost their job. Whatever the reason, sometimes creditors are prepared to wait until you resume your monthly repayments, while others put their foot down and pay a debt collection company like Vital Recovery Services to send a debt collector to recover the money.
There is nothing that could be more demoralizing than falling into debt, except the repeated contact with an aggressive debt collector who harasses you both day and night. Fortunately for you, the U.S. federal government has made it illegal for a third party debt collector to try and obtain a debt or make repeated and unwanted calls on a debtor. This is through The Federal Debt Collection Practices Act (FDCPA) which is in place to protect a debtor from being intimidated so much that they repay the debt.
What is the FDCPA?
The FDCPA’s role is to regulate what debt collection agencies like Vital Recovery Services can and cannot do. The FDCPA does not have the capacity to cancel a person’s debt but it can stop debt collectors from repeatedly phoning debtors concerning their debt.
It also stops debt collectors from inflicting physical harm or abusive verbal damage towards the debtor. According to the FDCPA, if a debt collector fails to behave in a responsible manner towards the debtor and there is sound evidence to prove it the debtor may be in the position to sue the debt collector for breaching privacy rules enforced by the FDCPA.
What Is and Isn’t Acceptable Behavior From Vital Recovery Services
Vital Recovery Services works as a debt collector on behalf of clients who are owed money. However, it cannot contact a debtor any time day or night. The antisocial hours that ensure privacy for the debtor are set at before 8’o’clock in the morning and after 9 ‘o’clock in the evening. Unless the debt collector has made prior arrangements to discuss the debt it cannot hound the debtor at any time of the day or night.
What to Do if Harassed by Vital Recovery Services
The first thing you should do is to ask the debt collector to stop making contact with you when you are at home. If there is no response and the debt collector starts to use abusive language, you may have the right to take legal action against the debt collector.
You can demand damages which includes legal fees. However, in order to be eligible you should file your damages claim within 12 months of the violation taking place.
How an Attorney can Help
It is possible for you to sue the debt collector, i.e. Vital Recovery Services, without any help, but overall you should find it a lot easier if you use an attorney to file legal action on your behalf. The attorney will know what you have said is true and any evidence showing illegal activity by the debt collector has been proven.
