If IQ Data International is contacting you about a past due debt and you believe that debt is invalid, you have the right to request information from IQ Data International. This information includes details of the debt and the name of the original creditor.
You are protected by the Fair Debt Collections Practices Act (FDCPA), which is a consumer protection act that was enacted to promote fairness and establish guidelines regarding debt collection practices.
The FDCPA offers guidelines to both parties involved, the consumer or debtor and the creditor or debt collector. The FDCPA allows the consumer to ask for debt validation, which allows the debtor to ask for proof of the debt.
After the collection agency has received your letter, they must stop all activity regarding collections until they supply proper validation showing the amount owed and that you are the responsible party.
Drafting Your Letter To IQ Data International
You should speak with an FDCPA lawyer, who can help you gather all the necessary information and documentation then draft the dispute letter. Your attorney will have experience in writing debt dispute letters and will have familiarity with the laws governing such transactions.
You might only have a limited amount of time for requesting validation of the debt, so contact an attorney as soon as possible.
While you might have a limited time to request verification, which is usually 30 days from the date you are contacted, the collection agency might not have a limited time in which to respond, so IQ Data International might be allowed to take their time providing proof, but you can specify a time limit in your letter.
You should contact an FDCPA attorney as soon as possible, so you can make sure your request is made in accordance to the statues of limitations.
Actual Sample Letter
I am requesting that IQ Data International provide me with the necessary information to validate the debt that they claim I owe. I am making in this request based on my rights under the Fair Debt Collection Practices Act, which is listed under 15 USC 1692g Sec. 809 (b).
I demand information about the amount of debt, the name of the creditor, the judgment (if there is one), your agreement with the creditor that authorizes you to collect this alleged debt on their behalf, valid copies of the debt agreement that shows the debt amount and any interest charges, your license to collect debts in my state, and when the last payment was made on this specific debt along with a complete payment history on this account and proof that the Statute of Limitations hasn’t expired.
If your office at IQ Data International fails to reply to this debt validation letter from within 30 days of the date it was received, all references to this account must be removed from my credit file. Any future attempts to collect this specified debt must be ceased.
If you fail to comply with my request for debt validation, it will be considered a waiver of claims to enforce debt against me and your implied agreement to compensate me for court costs and attorney fees if I must take this matter before a judge for a legal decision.
You should then sign the letter. Be sure to include the account number or reference number somewhere in the text of the letter, so IQ Data International can easily look up your account specifics. This will help them find the information that they have on hand regarding your alleged debt.
Talk to a Lawyer Today
You should speak to an FDCPA lawyer today. An attorney may be able to help you write a dispute letter to send to IQ Data International if you believe the company is pursuing you for an invalid debt claim. Remember, time is limited to request debt validation, so don’t wait until it is too long to ask for this information.
Otherwise, the collection agency can continue to pursue you for the debt they allege you owe. The FDCPA is there to protect your rights, so be sure to use this law to your advantage and to validate any debt that you might question.
