Is Vericore LLC Calling You? Here’s What You Need to Know

People can experience financial hardship through no fault of their own. Companies shut down, putting people out of work and making it impossible to maintain their monthly debt obligations. Once they miss a certain number of payments, creditors eventually turn the accounts over to third-party debt collectors or sell them to junk debt buyers. In either way, the collection calls and letters soon start. If this happens to you, don’t panic. Even if you owe money, you have rights that collectors cannot disregard without consequences.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act, or FDCPA, grants you the right to tell debt collectors not to contact you any more. It prohibits third-party collection agencies from using methods like the following while collecting or attempting to collect a debt:

  • Using profane or obscene language
  • Calling you at work when they know that your workplace won’t let you take such calls
  • Calling you before 8:00 a.m. and after 9:00 p.m. your time
  • Threatening you with consequences or actions they can’t legally take or have no intention of taking
  • Trying to collect an amount not authorized by law or by the original creditor agreement
  • Discussing the debt with anyone except you, your spouse, or your attorney

Vericore LLC is a collection agency located in Mandeville, Louisiana. It was founded in 2001, has 50-99 employees, and is managed by its President, Tim Sanderson. Litigation records archived at the PACER (Public Access to Court Electronic Records) website indicate that Vericore LLC has accused of violating the FDCPA during certain attempts at debt collection.

Alleged Violations against Vericore LLC

Shannan Luzansky vs. Vericore LLC et al

Beginning on or around February, 2014, Vericore LLC began contacting California resident Shannan Luzansky about an alleged debt. She later complained that collectors would call her on her cell phone and hang up before she could answer. She also alleged that she attempted to contact Vericore LLC to work out a payment arrangement, but the company refused, and instead subjected her to verbal threats.

During one conversation, a collector who identified himself as Chad Green allegedly used obscene and profane language and threatened to access Ms. Luzansky’s personal bank account without her permission, “come after [her] personally” and seize “everything that [she] own[s].”

During this phone conversation, Mr. Green allegedly stated they would not make a payment plan until they were given all of her personal and business bank statements and even her Profit and Loss Statement for her business.

On February 26, 2014, Mr. Green allegedly contacted Ms. Luzansky’s husband on his personal cell phone regarding his wife’s debt. When she discovered this, she hired a consumer attorney and sued Vericore LLC for the following alleged FDCPA violations:

  • Engaging in conduct intended to harass, oppress, or abuse her
  • Falsely implying that nonpayment of the debt would result in the seizure, garnishment, attachment, or sale of her property or wages
  • Threatening to take an action that cannot be legally taken or that was not actually intended to be taken
  • Using obscene or profane language
  • Contacting a third party for purposes other than obtaining location information

The matter was later settled.

If the collector swears at you, threatens you with legal action that never happens, and discusses your debt with third parties, hire a consumer attorney. We tried to reach a payment plan with Vericore and they and the vendor rejected this and this is what we got. Can they legally do this?
