Stop the
Harassment

You have legal rights. We can help.

If your hours are cut back at work and you haven’t been able to pay your bills in three months, you’ll soon be hearing from a collection agency. While it is legal for them to contact you and request payment, if they harass you they have broken the law and you can take action.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act, or FDCPA, is a federal law that protects consumers from debt collection practices that are unfair, unconscionable, and abusive. It was enacted in 1977 and forbids practices like those below.

  • Causing your phone to ring at all hours
  • Using hostile and obscene language
  • Contacting you directly after you retain a lawyer
  • Contacting you even after you dispute a debt
  • Refusing to validate the debt and prove that they are authorized to collect it
  • Discussing the debt with your family, friends, and co-workers

Alleged Violations against Simplified Revenue Recovery, LLC

According to PACER, on or around January 9, 2015, Simplified Revenue Recovery, LLC sent an email to a California consumer seeking payment for a rental debt. The original creditor’s claim had been dismissed in a previous court action but this demand was followed in February 2015 by a letter that threatened to take further “collection actions” beyond sending letters or making a credit report.

The consumer sent a dispute letter on or around March 13, 2015, and requested verification of the debt, but no verification allegedly came.

Feeling harassed by Simplified Revenue Recovery, LLC, the consumer took legal action against the agency, claiming that it:

  • Contacting her after she disputed the debt
  • Used false, deceptive, and misleading means to collect a debt
  • Threatening legal action it did not intend to take
  • Failing to send her a debt validation letter

The matter was later dismissed.
