Alleged Violations against Collection Results Inc.

According to PACER**, in late 2012, a Florida resident began receiving collection calls from Collection Results Inc about an overdue account at Coral Reef Gymnastics. On or about October 8, a collector who gave her name as “Angela” allegedly demanded payment immediately. When she disputed the debt, Angela allegedly used profane language, and threatened to report the alleged debt to the credit bureaus.

Another call took place the following day. During this communication, the collector allegedly did not identify herself, nor did she identify the name of her agency. She also allegedly began screaming at the Florida resident, demanding payment for the alleged debt and calling her names like “ghetto” and “scumbag”.

On or about October 30, 2012, Collection Results Inc. allegedly left the following voice message on her cell phone:

“Hi [Name of Plaintiff], this is Judy from Collection Results, following up. My number’s 954-428- 7676. I’m going to be leaving in a few minutes but I’m going to be here all day tomorrow, ’til about 7:30. So give me a buzz, thanks.”

The Florida resident hired a consumer attorney and filed a lawsuit accusing Collection Results Inc of violating the FDCPA in the following ways:

  • Failing to inform her that the call was from a debt collector and that any information would be used for that purpose
  • Using profane and obscene language
  • Failing to send a debt validation letter
  • Threatening legal action it had no intention of taking
  • Attempting to collect an amount not supported by law or the creditor agreement

The matter was later settled.

If either of these numbers show up on your caller ID, a debt collector is trying to reach you. If they use profane or obscene language, refuse to send a debt validation letter, or fail to identify themselves as debt collectors in each communication, hire an attorney. Such actions violate the FDCPA and you could potentially win $1,000 per FDCPA violation as well as attorney’s fees, court costs, and any actual damages. Be prepared to stand up for your rights, as doing so could put a debt collector in debt to you instead.
