Are you struggling in credit card debt? Are rude and unsympathetic debt collectors snapping at your heels? You aren’t the only one. The unfortunate reality is that millions of people have to use their credit cards to make ends meet and accrue a debt they have no means of repaying.

When collection agencies become abusive, it adds to the stress and anxiety. You don’t have to live like this: the law protects you when debt collectors go too far.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act, or FDCPA, is a federal law that prevents a third-party debt collector from bullying or deceiving consumers to collect a debt. If a collection agency violates the FDCPA by using tactics like those below, you may seek relief that includes statutory damages of up to $1,000.

  • Trying to get more money from you than you really owe
  • Speaking to you in an abusive manner
  • Calling your family and friends in an attempt to embarrass you into paying
  • Calling you at work when they know your employer prohibits such calls
  • Threatening to sue you on a debt barred by the statute of limitations.
  • Threatening to garnish your wages without a court order
